of Use
These Terms govern your access to and use of the HUMANDREAM Foundation website, digital platforms, programs, and services. Please read them carefully — they form a binding legal agreement between you and the Foundation.
Definitions & Parties
To ensure clarity and mutual understanding throughout this Agreement, the following terms shall have the meanings set forth below. All defined terms appear in these Terms and in our Privacy Policy, which is incorporated herein by reference in its entirety.
- "Foundation," "we," "us," "our"HUMANDREAM Foundation, Inc., a 501(c)(3) tax-exempt nonprofit corporation organized under the laws of the State of CA, EIN 39-2867584.
- "Site"The Foundation's website located at www.humandream.org and all associated subdomains, pages, and linked digital properties owned or operated by the Foundation.
- "Services"All programs, resources, tools, donation portals, event registrations, newsletters, applications, and other offerings made available through the Site or otherwise by the Foundation.
- "User," "you," "your"Any individual or entity that accesses, browses, registers on, donates through, or otherwise interacts with the Site or Services, whether registered or unregistered.
- "Content"All text, graphics, photographs, videos, audio, data, software, code, logos, trademarks, articles, reports, program materials, and any other materials published, uploaded, or made available on or through the Site.
- "User Content"Any materials, submissions, communications, or data that a User contributes, posts, uploads, or transmits to or through the Site or Services.
- "Agreement"These Terms of Use, together with the Privacy Policy and any additional policies, guidelines, or program-specific terms incorporated by reference herein.
Acceptance of Terms
By accessing the Site or using any Services — whether or not you create an account, make a donation, or apply to a program — you enter into a legally binding contract with HUMANDREAM Foundation, Inc. on the terms set forth in this Agreement. This acceptance is effective as of the date you first access the Site or Services.
If you are accessing the Site on behalf of an organization, employer, institution, or other legal entity, you represent and warrant that you have the authority to bind that entity to this Agreement, and all references to "you" shall encompass both you individually and that entity.
If you do not agree to these Terms or any portion thereof, your sole remedy is to discontinue use of the Site and Services and, if applicable, to contact us to close your account and request deletion of your personal data in accordance with our Privacy Policy.
Users must be at least thirteen (13) years of age to access the Site. Users between the ages of 13 and 17 may only use the Site with the verifiable consent and supervision of a parent or legal guardian who agrees to be bound by this Agreement on their behalf. Program-specific age requirements may apply and are disclosed at the point of registration.
Permitted & Prohibited Uses
The Site and Services are provided exclusively to advance the Foundation's charitable mission of empowering youth and young adults. Your use must be lawful, respectful, and consistent with that mission. The following governs acceptable and prohibited conduct.
- Browsing publicly available Site content for informational purposes
- Submitting charitable donations through our secure portal
- Applying for programs, scholarships, or volunteer opportunities
- Registering for events, webinars, or educational resources
- Sharing links to Foundation content on personal social media
- Contacting us with genuine inquiries, feedback, or media requests
- Downloading materials expressly made available for public distribution
- Unauthorized scraping, crawling, or automated data extraction
- Reproducing or republishing Foundation Content without written permission
- Impersonating the Foundation, its staff, or any program participant
- Submitting false, misleading, or fraudulent information or donations
- Uploading malware, viruses, or any disruptive or harmful code
- Circumventing any security measures or access controls
- Using the Site for commercial solicitation, spam, or unauthorized advertising
- Engaging in harassment, hate speech, or discriminatory conduct
Violation of any prohibition above may result in immediate termination of access, removal of User Content, and notification of relevant authorities where applicable. The Foundation reserves the right to pursue all available legal remedies for violations that cause harm to the organization, its participants, or its mission.
Intellectual Property Rights
All Content on the Site — including but not limited to text, design, graphics, logos, photographs, video, audio, program curricula, reports, research, and the underlying source code — is the exclusive property of HUMANDREAM Foundation, Inc. or its respective licensors and is protected by United States and international copyright, trademark, trade dress, and other intellectual property laws.
The HUMANDREAM name, logo, taglines, and program marks are registered or common-law trademarks of the Foundation. Nothing in this Agreement grants you any right or license to use Foundation trademarks, service marks, or trade names without the Foundation's prior express written consent.
Subject to your compliance with this Agreement, the Foundation grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Site and its publicly available Content solely for personal, non-commercial informational purposes consistent with our mission. This license does not include the right to: (a) copy, reproduce, modify, distribute, or create derivative works; (b) frame or mirror any portion of the Site; (c) use Content for commercial advantage; or (d) remove any copyright, trademark, or other proprietary notices.
Any use of Site Content beyond this limited license requires the Foundation's prior written authorization. To request a license, contact contact@humandream.org.
User Content & Submissions
Certain areas of the Site or Services may permit you to submit User Content, including testimonials, applications, feedback, survey responses, event photos, or communications. By submitting User Content, you represent and warrant that: (a) you are the original creator and owner of the content or have all necessary rights and permissions; (b) the content does not infringe any third-party intellectual property, privacy, or publicity rights; (c) the content is truthful, accurate, and not misleading; and (d) the content does not violate any applicable law or this Agreement.
By submitting User Content to the Foundation, you grant HUMANDREAM Foundation, Inc. a worldwide, royalty-free, perpetual, irrevocable, non-exclusive license to use, display, reproduce, adapt, publish, translate, and distribute your User Content in any media for Foundation mission-related purposes, including marketing, impact reporting, grant applications, and educational materials. You waive any moral rights you may have in such content to the fullest extent permitted by law.
The Foundation reserves the right, but assumes no obligation, to review, moderate, edit, or remove any User Content at its sole discretion and at any time, without notice. Submission of User Content does not create any obligation for the Foundation to publish, use, retain, or compensate you for such content.
Donations & Financial Transactions
HUMANDREAM Foundation, Inc. is recognized as a tax-exempt public charity under Section 501(c)(3) of the Internal Revenue Code. Contributions to the Foundation are generally tax-deductible to the extent permitted by law. The Foundation will provide written acknowledgment of contributions in compliance with IRS substantiation requirements.
All financial transactions conducted through the Site are processed by PCI-DSS compliant third-party payment processors. The Foundation does not store raw payment card data on its servers. By initiating a financial transaction, you authorize the Foundation and its payment processors to charge the specified amount to your selected payment method.
- All Donations Are FinalCharitable donations are generally non-refundable once processed. The Foundation will consider refund requests submitted within seven (7) days of an erroneous or unauthorized charge on a case-by-case basis. Contact contact@humandream.org to initiate a refund request.
- Recurring GiftsIf you establish a recurring donation, you authorize the Foundation to charge your payment method on the agreed schedule until you cancel. You may cancel at any time by contacting us at least five (5) business days before the next scheduled charge.
- Restricted GiftsDonations designated for a specific program or initiative are subject to the Foundation's gift acceptance policies. The Foundation reserves the right to redirect restricted gifts to its general operating fund if the designated purpose becomes impracticable, consistent with donor intent and applicable law.
- Tax ReceiptsElectronic tax receipts are issued for all donations within five (5) business days of receipt. It is your responsibility to consult a tax advisor regarding the deductibility of your contribution under your specific circumstances.
- Fraudulent TransactionsSubmitting fraudulent payment information or chargebacks without good faith dispute basis may result in permanent account termination and referral to law enforcement.
Third-Party Links & Resources
The Site may contain hyperlinks to third-party websites, platforms, resources, and services, including partner organizations, grant-making institutions, social media networks, and event platforms. These links are provided for informational convenience and do not constitute an endorsement, sponsorship, or recommendation by the Foundation of the linked content, organization, or service.
The Foundation has no control over, and assumes no responsibility for, the content, accuracy, privacy practices, security measures, or terms of service of any third-party site. You access third-party sites entirely at your own risk, and you agree that the Foundation shall not be liable for any harm, loss, or damage arising from your use of or reliance on any third-party site or its content.
Third parties linking to the Foundation's Site must do so in a manner that is fair, legal, and does not damage our reputation or imply endorsement. Framing, embedding, or hotlinking of Foundation Content without prior written authorization is strictly prohibited.
Privacy & Data Protection
Your use of the Site and Services is also governed by our Privacy Policy, which is incorporated into this Agreement by reference and made a part hereof as if fully set forth herein. The Privacy Policy describes how we collect, use, store, share, and protect your personal information, as well as your rights regarding that information.
By agreeing to these Terms, you also acknowledge and agree to the data practices described in the Privacy Policy. If there is any conflict between these Terms and the Privacy Policy regarding the handling of personal data, the Privacy Policy shall govern.
Disclaimers & Warranties
THE SITE AND ALL SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE FOUNDATION EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.
THE FOUNDATION DOES NOT WARRANT THAT: (A) THE SITE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (B) ANY CONTENT OR INFORMATION OBTAINED THROUGH THE SITE WILL BE ACCURATE, COMPLETE, OR RELIABLE; (C) ANY DEFECTS OR ERRORS WILL BE CORRECTED; OR (D) THE SITE OR ITS SERVERS ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
Information published on the Site is provided for general informational and educational purposes only. Nothing on the Site constitutes legal, financial, medical, psychological, or professional advice. The Foundation strongly encourages users to seek qualified professional counsel for any decisions of legal, financial, health, or personal significance.
Program outcomes described on the Site are illustrative of typical results and do not guarantee individual outcomes. Youth empowerment is a complex and deeply personal journey, and the Foundation makes no representations regarding specific results any participant may achieve.
Limitation of Liability
To the maximum extent permitted by applicable law, HUMANDREAM Foundation, Inc., its directors, officers, employees, volunteers, agents, affiliates, program partners, and licensors shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages arising out of or related to your use of or inability to use the Site or Services, including but not limited to damages for loss of data, loss of goodwill, service interruption, computer damage, or any other commercial damages or losses.
In jurisdictions that do not allow the exclusion or limitation of incidental or consequential damages, the Foundation's liability shall be limited to the fullest extent permitted by law. In no event shall the Foundation's total aggregate liability to you for all claims arising out of or related to this Agreement exceed the greater of: (a) the total amount of charitable donations you made to the Foundation in the twelve (12) months preceding the claim; or (b) one hundred United States dollars (US$100.00).
The disclaimers and limitations in this section reflect a reasonable and fair allocation of risk between you and the Foundation, and are a fundamental basis of the bargain between the parties. The Foundation would not be able to provide its mission-driven services without these limitations.
Indemnification
You agree to defend, indemnify, and hold harmless HUMANDREAM Foundation, Inc. and its directors, officers, employees, volunteers, contractors, agents, successors, and assigns from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your access to or use of the Site or Services; (b) your violation of this Agreement or any applicable law or regulation; (c) your User Content or any claims that your User Content infringes, misappropriates, or violates any third-party right; (d) your negligent or willful misconduct; or (e) any misrepresentation made by you to the Foundation.
The Foundation reserves the right, at its own expense, to assume exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate fully with the Foundation in asserting any available defenses. You may not settle any claim subject to this indemnification without the Foundation's prior written consent.
Termination of Access
The Foundation reserves the right, in its sole and absolute discretion, to suspend, restrict, or permanently terminate your access to the Site, any account, or any Services — with or without notice — for any reason, including but not limited to a breach of this Agreement, fraudulent activity, conduct harmful to the Foundation's mission or community, or as required by applicable law.
Upon termination: your right to access and use the Site ceases immediately; any licenses granted to you under this Agreement are revoked; the Foundation may, but is not required to, delete your account and User Content; and provisions of this Agreement that by their nature should survive termination shall survive, including without limitation Sections 4, 5, 9, 10, 11, 13, and 14.
You may terminate your own account or relationship with the Foundation at any time by contacting us in writing. Termination does not affect any rights or obligations that arose prior to termination, including any outstanding donation commitments or program agreements.
Governing Law & Dispute Resolution
This Agreement shall be governed by, construed, and enforced in accordance with the laws of the State of [State], without regard to its conflict of law provisions. You agree that any legal action, proceeding, or dispute arising from or relating to this Agreement or your use of the Site shall be brought exclusively in the state or federal courts of competent jurisdiction located in [County], [State], and you hereby irrevocably submit to the personal jurisdiction of those courts.
Informal Resolution: Prior to initiating any formal legal proceeding, both parties agree to attempt good-faith informal resolution of any dispute. You may contact the Foundation at contact@humandream.org describing the nature of the dispute and the relief sought. The Foundation will respond within thirty (30) days. If the dispute is not resolved within sixty (60) days of initiation of informal resolution, either party may proceed to formal dispute resolution.
To the extent permitted by applicable law, you waive any right to participate in a class action lawsuit or class-wide arbitration against the Foundation. Any dispute must be brought in your individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.
Notwithstanding the foregoing, the Foundation retains the right to seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of its intellectual property or other proprietary rights.
Miscellaneous Provisions
Entire Agreement. This Agreement, together with the Privacy Policy and any other policies expressly incorporated by reference, constitutes the entire agreement between you and HUMANDREAM Foundation, Inc. with respect to the subject matter herein, and supersedes all prior and contemporaneous communications, agreements, and understandings, whether oral or written.
Severability. If any provision of this Agreement is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, or if it cannot be so modified, severed from this Agreement. The remaining provisions shall continue in full force and effect.
Waiver. The Foundation's failure to enforce any right or provision of this Agreement shall not constitute a waiver of that right or provision. Any waiver must be in writing and signed by an authorized representative of the Foundation.
Assignment. You may not assign or transfer this Agreement or any rights hereunder without the Foundation's prior written consent. The Foundation may assign this Agreement freely, including in connection with a merger, acquisition, or transfer of substantially all of its assets or programs.
Force Majeure. The Foundation shall not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including acts of God, natural disasters, pandemic, government action, internet outages, or other unforeseeable events.
Accessibility. The Foundation is committed to making its Site accessible to individuals with disabilities in accordance with the Web Content Accessibility Guidelines (WCAG) 2.1. If you encounter accessibility barriers, please contact us at contact@humandream.org.
Language. This Agreement is drafted in the English language, which shall be the controlling language for all purposes. Any translations are provided for convenience only.
Updates to These Terms
HUMANDREAM Foundation, Inc. reserves the right to amend, update, or replace these Terms of Use at any time at its sole discretion. We will provide notice of material changes by: posting a prominent notice on the Site's homepage and this page for at least thirty (30) days before the effective date; updating the "Last Revised" date at the top of this Agreement; and, for registered account holders and active donors, sending email notification to the address on file.
Your continued access to or use of the Site or Services after the effective date of any revised Terms constitutes your acceptance of the changes. If you disagree with any revision, you must cease using the Site and notify us to close your account. Non-material changes (typographical corrections, formatting updates, clarifications that do not alter legal meaning) may be made without prior notice.
It is your responsibility to review these Terms periodically. Archived versions of prior Terms are available upon written request to contact@humandream.org.
